Tire makers run their own in-house tests, or contract the testing to an independent lab. The tires are placed on machines that measure tread wear, durability, load capacity and air retention. Indoor labs run tires on a flat glass surface to mark the “footprint” of the tire. Road wheels, big circular-running tire-mounts that simulate moving tires on pavement, can run a tire for days to test how soon it will fail. The tires are also taken out of the labs and placed on cars to test real-road conditions, including inclement weather simulations. Tire companies then receive detailed reports about the performance of test tires, which they use to compare to performance expectations. The initial transaction in this case was between petitioner and Fojas-Arca, whereby the latter purchased tires from the former with special withdrawal slips drawn upon Fojas-Arca’s special savings account with respondent bank. Petitioner in turn deposited these withdrawal slips with Citibank. The latter credited the same to petitioner’s current account, then presented the slips for payment to respondent bank.

In fact, it is worth recalling that under Article VI, Section 1 of the Constitution, the legislative power of Congress is limited to the extent reserved to the people by the provisions on initiative and referendum. The ruling of this Court is of the nature of an in rem judgment barring any and all Filipinos from filing a petition for initiative on amendments to the Constitution until a sufficient law shall have been validly enacted. Clearly, the COMELEC, in denying due course to the present petition for initiative on amendments to the Constitution conformably with the Court’s ruling in Santiago did not commit grave abuse of discretion. On the contrary, its actuation is in keeping with the salutary principle of hierarchy of courts. For the Court to find the COMELEC to have abused its discretion when it dismissed the amended petition based on the ruling of this Court in Santiago would be sheer judicial apostasy. There is absolutely no showing here that petitioners complied with R.A. 6735, even as they blindly invoke the said law to justify their alleged people’s initiative. In the instant case, the Constitution sets in black and white the requirements for the exercise of the people’s initiative to amend the Constitution. The amendments must be proposed by the people “upon a petition of at least twelve per centum of the total number of registered voters, of which every legislative district must be represented by at least three per centum of the registered voters therein.

Can Trump be barred from running for president if found to have violated the Records Act?

Basically, revision suggests fundamental change, while amendment is a correction of detail. It cannot be denied that in Santiago, a majority of the members of this Court or eight Justices (as against five Justices) concurred in declaring R.A. When the motion for reconsideration was denied via an equally-divided Court or a 6-6 vote, it does not mean that the Decision was overturned. It only shows that the opposite view fails to muster enough votes to modify or reverse the majority ruling. History has been a witness to countless iniquities committed in the name of God. Wars were waged, despotism tolerated and oppressions justified—all these transpired as man boasted of God’s imprimatur. Today, petitioners and their allies hum the same rallying call, convincing this Court that the people’s initiative is the “voice of the people” and, therefore, the “voice of God.” After a thorough consideration of the petitions, I have come to realize that man, with his ingenuity and arrogance, has perfected the craft of imitating the voice of God. It is against this kind of genius that the Court must guard itself. In T.N.F., a majority of the justices sitting did not agree on a common rationale, as two of four participating justices agreed that the state’s one-year statute of limitations applied, one justice concurred in the result only, and one justice dissented.

On the day in question, he was given two bundles of wool flannel swabs for cleaning disks. He used four swabs from one pack and kept the rest in his “blue travelling bag.” 10 Why he placed the swabs in his personal bag, which is not the usual receptacle for company property, has not been satisfactorily explained. The local civil registrar shall require the payment of the fees prescribed by law or regulations before the issuance of the marriage license. No other sum shall be collected in the nature of a fee or tax of any kind for the issuance of said license. It shall, however, be issued free of charge to indigent parties, that is, those who have no visible means of income or whose income is insufficient for their subsistence, a fact established by their affidavit or by their oath before the local civil registrar. In the case at bar, it appears that Citibank, with the knowledge that respondent Luzon Development Bank, had honored and paid the previous withdrawal slips, automatically credited petitioner’s current account with the amount of the subject withdrawal slips, then merely waited for the same to be honored and paid by respondent bank. Hence, the rule on immediate notice of dishonor is non-applicable to the case at hand. Thus, the bank was under no obligation to give immediate notice that it wouldn’t make payment on the subject withdrawal slips. Citibank should have known that withdrawal slips are not negotiable instruments. It couldn’t expect then the slips be treated like checks by other entities.

LEXOTERICA: A PHILIPPINE BLAWG

Oppositors to the people’s initiative point out that this Court ruled in Santiago that RA 6735 was inadequate to cover the system of initiative on amendments to the Constitution and, thus, no law existed to enable the people to directly propose changes to the Constitution. The life of the law is not logic but experience.1 Our collective experience as a nation breathes life to our system of laws, especially to the Constitution. These cases promise to significantly contribute to our collective experience as a nation. Fealty to the primary constitutional principle that the Philippines is not merely a republican State but a democratic one as well behooves this Court to affirm the right of the people to participate directly in the process of introducing changes to their fundamental law. Thus, this is an opportune time for this Court to uphold the sovereign rights of the people. The COMELEC had indeed committed grave abuse of discretion when it summarily dismissed Lambino and Aumentado’s petition for initiative entirely on the basis of the Santiago case which, allegedly, permanently enjoined it from entertaining or taking cognizance of any petition for initiative to amend the Constitution in the absence of a sufficient law.

The President was informed that the two subjects are at present given in public schools as optional subjects. The President also held conferences in the morning with Acting Executive Secretary Mariano Yenko, Jr., GSIS Manager Rodolfo P. Andal, Judge Salvador Esguerra, and Lieut. December 24.—PRESIDENT Magsaysay today directed Justice Secretary Pedro Tuason to designate Mariano Almeda of the National Bureau of Investigation as special prosecutor to assist the provincial fiscal of Isabela in the handling of murder cases unearthed by the latter as presidential investigator. Upon receiving information from Defense Undersecretary Jose M. Crisol that the killers of Villapando were soldiers and hence were not eligible to the awards because of the executive order, the President said that he would amend the executive order to include soldiers as recipients of the awards under special conditions. Crisol sat in for Defense Secretary Sotero B. Cabahug, who could not attend the Cabinet meeting, as he officiated at the observance of the 20th anniversary of the Armed Forces of the Philippines at Camp Murphy.

Brought before the President, Segundo narrated his role in the ambush. He pointed to Pablo Dapian, his brother-in-law, and Vicente Cainit as the mastermind and his companion, respectively, in the ambuscade. THE President granted executive clemency to 67 prisoners this day, Christmas Day. Upon reading in the morning papers of the arrest of the three suspects who allegedly fired at a Rural Transit passenger bus, resulting in the killing of eight and the wounding of 17 passengers, the President decided to go to Camp Olivas to question the suspects personally. “The government is doing everything within its power to bring about better standards of living for all, especially for those in the barrios. We are laying the foundations upon which to fashion a more peaceful, more substantial, and more progressive way of life. This is my dream for all, and with God’s help and with your support and cooperation it is taking on shape. The full realization of this dream is my fervent Christmas wish for our countrymen. The award was first presented by the President to Mrs. Camacho and then to Cpl. Martillana, an alert-looking soldier.

Under Republic Act No. 1194, only the President may authorize the importation of Virginia leaf tobacco. THE PRESIDENT this morning swore in several local political leaders who affiliated with the Nacionalista Party. Among those sworn in were Mayors-elect Pilar Tolentino-Rodriguez of Macalelon, Quezon, wife of former NPC General Manager Filemon Rodriguez, who ran as an independent during the last elections; and Lope Daez of Meycauayan, Bulacan, an LP. The Chief Executive charged the committee with the study of the laws which impose severe tax obligations and other unnecessary burdens on poor fishermen with a view to proposing amendments to these laws during the next session of Congress.

Some even thought I was a missionary, after all, I was too hairy to be in the military and tourists just don’t come to Zamboanga. Of the ships wake disappearing into the darkness, an older man joins me. “You cannot sleep” he says “no” I look at my watch it’s 1am. ” He immediately brightens to this topic; his wife is from Basilan he tells me, though neither he nor his wife have been there for 20 years, he proceeds to tell me all about the two main towns Isabela and Lamitan…and it’s true – they have PINK sandy beaches on Santa Cruz! Finally, I thought; some firsthand information not based on hearsay. However, we learned that an unscrupulous businessman, who is not an authorized tire importer, is bringing in Bridgestone tires that may or may not be meant for our market.

He said that the restrictions being imposed by the government agencies were causing hardship to the fishing industry, on which some 14,000 people in their town alone depended as their only means of livelihood. Encarnacion also said that other inhabitants of other fishing towns along Manila Bay were facing the same difficulties as a result of the restrictions. CASES said that he would file a bill in Congress establishing a cigar factory in the Cagayan Valley. The La Union solon said that a cigar factory was necessary because of the big demand for local cigars.

THE President conferred this morning with Judge Guillermo B. Guevara, presidential prober, who called at Malacañang to submit a 14-page report on his investigation of the Monetary Board of the Central Bank in connection with alleged dollar quota anomalies. S. Ambassador Homer Ferguson, Dr. Gumercindo Garcia and Dr. Fortunato Guerrero, presidents of the Philippine Chapter of the International College of Surgeons and the Philippine College of Surgeons respectively, and Ray Higgins. McIntyre, who had been a personal surgeon to the late President Franklin D. Roosevelt, is here as guest of honor of the joint convention of the Philippine College of Surgeons and the Philippine Chapter of the International College of Surgeons. December 10.—PRESIDENT Magsaysay this morning received in his study room Admiral Ross McIntyre , former surgeon general of the U.S. The President also requested that he be given the plan of how the Council of Personnel Administration office was working out under the office of Director Pineda, so that his model plan could be distributed to other offices for more effective government service. The President was given another applause when he expressed himself as against the mass laying off of government employees if and when the reorganization commission’s plan to streamline the government is put into effect. He recalled his own sufferings when his father had been laid off as a school teacher way back in 1914 and said that he did not want the same sufferings to be experienced by his fellow workers and employees. Following his speech, the President held an open forum during which he heard complaints and recommendations of government employees. During their call, the President impressed upon the customs collectors the importance of their jobs which, according to him, demand utmost integrity and honesty.

Ford had repeatedly said during the first week of August 2000 that it would continue to use tires made by Firestone. Then according to a Reuters’ release on September 28, Ford Motor Co. To compound its woes, Firestone’s inventory of unsold tires was 50 percent larger than usual at the end of October 2000, partly because of the slower sales but also because the company stockpiled tires in summer 2000 in preparation for a possible strike by union workers that did not take place. In addition, the company has found saddled itself with large numbers of tires in smaller sizes as more Americans chose vehicles that use larger tiresxxx. The claims rate for Wilderness tires made in Decatur began to fall in 1997 and is now virtually equal to the claims rate for Wilderness tires made elsewhere. But Bridgestone is recalling all Wilderness tires made in Decatur since 1996 as a precautionxxviii. At the Decatur plant itself, the claims rate soared to between 350 and 650 claims per million ATX tires produced in 1994, 1995 and 1996. There have been virtually no claims for any of the recalled tires in New York, New Jersey and Connecticut, with almost all problems occurring in hotter states. The claims rate was far higher for ATX tires, all of which are being recalled in the P235/75R15 size regardless of where they were produced.

6735 and Comelec Resolution 2300 provide more than sufficient authority to implement, effectuate and realize our people’s power to amend the Constitution. Calling a plebiscite to be held not earlier than sixty nor later than ninety days after the Certification by the COMELEC of the sufficiency of the petition, to allow the Filipino people to express their sovereign will on the proposition. While the permanent injunction contemplated in the Conclusion encompasses all petitions for initiative on amendments to the Constitution, the fallo is expressly limited to the Delfin Petition. To resolve the conflict, the final order of the Court as it is stated in the dispositive portion or the fallo should be controlling. No less than its very first paragraph, the Preamble,1 expressly recognizes that the Constitution came to be because it was ordained and promulgated by the sovereign Filipino people.
White House: Griner, wife to talk after call 'error'52d
THE President this afternoon formed a committee to study ways of lightening the burden on small fishermen through the modification of some laws affecting this group. Other NWSA officials with whom the President conferred during his visit were Jesus Perlas, assistant manager; Emilio Agregado, treasurer; Rufo Fabugas, executive officer; Macario Juinio, auditor, Santiago F. Rep. Manuel Cases of La Union, who was not able to see the President the other day to take part in the deliberations confronting the tobacco industry, called on the President to inform him that he agreed on the measures contemplated to protect all the parties involved in the tobacco industry. criminals The measures had been decided at the President’s conference with leading officials of the Ilocos provinces. Mayor Norberto Amoranto of Quezon City also sought the President’s assistance in connection with a project put up by the city for the drainage of stagnant water in many of the city’s residential districts. Mayor Amoranto informed the President that the incidence of H-fever in the locality had been attributed to the presence of stagnant water during rainy seasons. It may well be pointed out that in making the distinction between amendment and revision, Justice Antonio relied not only in the analogy presented in Wheeler v. Board of Trustees, 37 S.E.

  • As our constitutions are superior to our legislatures, so the people are superior to our constitutions.
  • In that case, the McFadden court found the proposed changes extensive since at least 15 of the 25 articles contained in the California Constitution would either be repealed in their entirety or substantially altered, and four new topics would be introduced.
  • Lambino stated that he and his group assured the people during the signature-gathering that the elections for the regular Parliament would be held during the 2007 local elections if the proposed changes were ratified before the 2007 local elections.
